Information Clause

 

On account of the entry into force on 25 May 2018 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: "GDPR"), we notify you that starting from 25 May 2018, you will have the rights set forth below related to the processing by Savills sp. z o.o., with its registered office in Warsaw, of your personal data.

 

1. The following entities are the controllers of your personal data:

Savills sp. z o.o.; and

Savills Property Management sp. z o.o., both with their registered office in Warsaw (00-133), al. Jana Pawła II 22 (hereinafter collectively: "Savills").

2. Savills has not designated the Data Protection Officer responsible for the area of processing of personal data as a part of Savills' operations. 3. Savills processes the following categories of your personal data:

3a identification data [such as full name / sex / preferred contact language];

3b contact data [such as e-mail, telephone number];

3c employment data [such as place of employment or place of provision of services - business name and contact address, job position, department].

 

4. Savills obtains personal data directly from you, from a Savills' Client as a part of a business relation in which you participate as well as from publically available sources (such as websites on which your data is available).

 

5. Savills processes your personal data for the following purposes:

5a. marketing and promotion of products and services offered by Savills (legal basis: Article 6(1)(a) of GDPR);

5b. marketing (in particular for the purpose of sending commercial information and offers) of products and services of Savills' business partners and Savills Group* entities listed in the footer (legal basis: Article 6(1)(a) of GDPR);

5c. for the establishment, exercise or defense of legal claims (legal basis: Article 6(1)(f) of GDPR);

5d. for the internal administrative purposes of Savills, including the statistical, communication and internal reporting purposes of Savills and Savills Group* entities listed in the footer (legal basis: Article 6(1)(f) of GDPR);

5e. for continuous and uninterrupted operations by Savills trough ensuring the integrity of archived/backup/emergency copies (legal basis: Article 6(1)(f) of GDPR).

 

6. In connection with the processing of your personal data for the purposes referred to in item 5) above, your personal data may be disclosed to other data recipients. The recipients of your personal data may include, but are not limited to:

6a. entities authorised to receive your personal data pursuant to the applicable provisions of law;

6b. Savills Group* entities;

6c. entities that process your personal data on behalf of Savills under a contract with Savills entrusting the processing of personal data (processors) such as IT services, invoicing services, law firms and real estate agents).

 

7. Your personal data shall be processed for the period required to carry out the purposes of the processing listed in item 5) above, i.e.:

7a. if you have given your consent to the data processing, until the consent is withdrawn;

7b. with regard to internal administrative purposes and for the purposes of the legitimate interests pursued by Savills, for the period until the realisation of the legitimate interest of Savills that constitutes the basis for such processing or until you object to such processing, but no later than for 24 months following the date of your registration in Savills' system or, in the case of your business relationship with Savills, 24 months following the date of termination of such a business relationship.

 

8. In connection with the processing by Savills of your personal data, you have the following rights:

8a. the right to access data pursuant to Article 15 of GDPR;

This is the right to obtain from Savills confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data (including its copies) and, in particular, the following information: (i) the purposes of the processing; (ii) he categories of personal data concerned; (iii) the recipients or categories of recipient to whom the personal data have been or will be disclosed by Savills; (iv) the existence and manner of exercise of rights pertaining to personal data protection; (v) the right to lodge a complaint with a supervisory authority; (vi) profiling and the consequences of such processing for you.

8b. the right of rectification pursuant to Article 16 of GDPR;

This is the right to request from Savills without undue delay the rectification of inaccurate personal data concerning you and to request the completion of incomplete personal data.

8c. the right of erasure pursuant to Article 17 of GDPR;

This is the right to request from Savills the erasure of personal data concerning you (also referred to as the "right to be forgotten") without undue delay. In such a case, Savills shall have the obligation to erase personal data where one of the following grounds applies: (i) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; (ii) the consent on which the processing is based has been withdrawn and Savills has no other legal ground for the processing; (iii) the personal data have been unlawfully processed; (iv) the personal data have to be erased for compliance with a legal obligation.

The right to obtain the erasure of personal data may not be exercised where Savills has a legal obligation to continue to process the personal data in the extent set forth by the applicable laws or for the establishment, exercise or defence of legal claims.

8d. the right of restriction of processing pursuant to Article 18 of GDPR;

This is the right to request from Savills restriction of processing of your personal data where one of the following applies: (i) the accuracy of the personal data processed by the controller is contested by you; (ii) the processing of your personal data is unlawful and you opposes the erasure of your personal data; (iii) Savills no longer needs the personal data, but they are required by you for the establishment, exercise or defence of legal claims.

Where the right of restriction has been exercised, such personal data shall, with the exception of storage, only be processed by Savills with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

8e. the right to object to data processing pursuant to Article 21 of GDPR;

You have the right to object at any time to processing of personal data concerning you which is based on Savills' legitimate interest (i.e. on point (f) of Article 6(1) of GDPR). In such a case, Savills shall no longer process the personal data for that purposes unless there are compelling legitimate grounds for the processing or for the establishment, exercise or defence of Savills' legal claims.

The right to object to data processing shall not apply where: (i) the processing of personal data is based on consent – in such a case, the consent may be however withdrawn; (ii) the data processing is necessary for the performance of a contract to which you are a party; (iii) the data processing is required for Savills' compliance with a legal obligation.

8f. the right to data portability pursuant to Article 20 of GDPR;

This is the right to receive the personal data concerning you, which you have provided to Savills, in a structured, commonly used and machine-readable format and the right to transmit those data to another controller, where technically feasible. You have this right is the data is processed on the basis of a consent or in connection with a contract.

 

9. In the cases where your data is processed pursuant to Article 6(1)(a) of GDPR, i.e. on the basis of consent to the processing of personal data, you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

 

10. You have the right to notify the exercise of your rights referred to in items 8) and 9) above in the following manner:

11. If you consider that the processing of your personal data by Savills breaches the provisions of GDPR, you have the right to lodge a complaint with a supervisory authority (in the territory of Poland, this means the President of the Office for the Protection of Personal Data).

 

12. In the case where Savills obtains personal data directly from you, please be advised that the provision of data is voluntary, however, as a result of non-provision of required data, Savills will be unable to carry out the purpose of the processing with regard to the activities as a part of which the personal data obtained from you is processed.

 

13. Savills may transfer your personal data to a third country, namely the United States, to the extent to which is uses the services of entities that store data on servers in that country. The entity to which the data is transferred is a member of the Privacy Shield, which means that pursuant to the decision of the European Commission with regard to entities within the framework of the Privacy Shield, this country offers an adequate level of data protection of your personal data.

 

14. The recipient of your personal data in the United States is SalesForce.com, Inc., which is entrusted with the data for processing in connection with the rendering to Savills of services involving the provision of mailing technological solutions.
